WORKBAY MARKETPLACE (formally known as, AfriLancers) Dispute Resolution Policy
Introduction:
At WORKBAY MARKETPLACE, we strive to create a fair and transparent environment for both potential clients and skilled Africans.
However, disputes may occasionally arise during the course of a project. This Dispute Resolution Policy is designed to help resolve such disputes in an equitable and efficient manner.
1. Open Communication:
The first step in resolving a dispute on WORKBAY MARKETPLACE is open communication between the client and the skilled African. We strongly encourage both parties to engage in constructive dialogue to address any issues or concerns.
2. Escalation to WORKBAY MARKETPLACE Support:
If communication between the potential client and the skilled African does not lead to a satisfactory resolution, either party may contact WORKBAY MARKETPLACE Support through the platform for assistance.
NOTE:
Please provide a detailed description of the issue, relevant project details, and any supporting documents.
3. Mediation:
WORKBAY MARKETPLACE Support will review the case and may offer mediation services to help both parties reach an agreement. Mediation is a non-binding process where a neutral third party helps facilitate communication and negotiation between the client and skilled African.
4. Arbitration:
If mediation does not result in a resolution, the dispute may proceed to arbitration. WORKBAY MARKETPLACE will appoint an arbitrator or may use a trusted third-party dispute resolution service. The decision of the arbitrator is final and binding on both parties.
5. Resolution and Enforcement:
Upon receiving the arbitrator's decision, both the client and freelancer are expected to comply with the ruling. Failure to do so may result in account suspension or other penalties. WORKBAY MARKETPLACE will also facilitate any necessary fund transfers as per the arbitration decision.
6. Preventing Future Disputes:
To reduce the likelihood of future disputes, clients and freelancers are encouraged to set clear project expectations, milestones, and payment terms in their project agreements. Additionally, using WORKBAY MARKETPLACE built-in project management tools, such as time tracking and milestone tracking, can help maintain transparency and accountability.
7. Reporting Violations:
If either party believes that the other has violated WORKBAY MARKETPLACE Terms of Service or Code of Conduct during the dispute resolution process, please report such violations to WORKBAY MARKETPLACE Support for further investigation.
Conclusion:
WORKBAY MARKETPLACE is committed to ensuring a fair and efficient dispute resolution process for our users. We encourage all parties to work together to resolve issues amicably and, when necessary, rely on our mediation and arbitration services to reach a fair resolution.
